The General Terms and Conditions of Business govern the distance selling relationship between ELIWELL IBÉRICA, S.A. and the user or customer, in accordance with the legal stipulations, in particular, Law 7/1998 of 13 April on General Conditions of Contract, Law 3/2014 of 27 March amending the revised text of the General Law for the Defence of Consumers and Users, the Royal Decree 1906/1999 of 17 December 1999, which regulates Telephone or Electronic Contracting with general conditions, Organic Law 15/1999, of 13 December, on the Protection of Personal Data, Law 7/1996, of 15 January, on the Regulation of Retail Trade, and Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce.

1.3. ELIWELL IBÉRICA, S.A. reserves the right to make any changes it deems appropriate, without prior notice, to the General Terms and Conditions. Such modifications may be made, through its websites, by any legally admissible means and shall be binding for as long as they are published on the website and until they are validly modified by subsequent modifications. However, ELIWELL IBÉRICA, S.A. reserves the right to apply, in certain cases, Special Conditions of Contract in preference to these General Conditions when it deems appropriate, announcing them in a timely manner.

1.4. Likewise, when the contractual relationship has been determined by agreement or pact between ELIWELL IBÉRICA, S.A. and the User and/or has been perfected through a prior commercial contract, the latter shall take precedence over these General Online Terms and Conditions.

1.6. The customer, upon receipt of the product at the delivery address provided, will receive an invoice or copy of the order.

1.7. The User declares that he/she is eighteen years of age and has the legal capacity to make a purchase and sale on this website. The User undertakes to comply with the present Terms and Conditions.

The purpose of the website is to offer and advertise the sale of products marketed by ELIWELL IBÉRICA, S.A. as a distributor of products for electronic control and regulation.

The duration of the contract shall be linked to the delivery of the product without prejudice to the right of withdrawal and the prior commercial contract established between the parties.

You may also subscribe to the newsletter to receive offers on the aforementioned products or general information that may be of interest to you.

As a user or customer, you expressly declare that you know, understand and accept the terms and conditions of use and these general terms and conditions of contract. Likewise, you declare that you are of legal age and have the necessary legal capacity to access the ELIWELL IBÉRICA, S.A. websites and to contract through them.

5.1. To purchase our products, you can go to the sections available on the website itself.

5.2. It is a prerequisite that you have been registered as a user of the website to make the purchase online.

5.3. During the purchase process you must identify yourself with the username and password provided. These data will not be made public. You are responsible for treating confidentially and responsibly the identity and password obtained in the registration as a customer, not being able to transfer them to another. You can modify the information registered at any time, in your customer area. In this same section you will have access to a history of your orders, this is only a consultation section, but its management is allowed, and the user can delete those records that he/she considers it is not necessary to view.

5.4. Once the purchase process has been completed, the customer will receive a confirmation of the purchase by e-mail. It is essential that during the purchase process the user indicates a valid email address. 6.1. In the case of a product on offer, the offer price and the validity of the offer shall always be indicated next to the essential characteristics of the product.

6.2. In compliance with current regulations, ELIWELL IBÉRICA, S.A. provides information on all items on sale, their characteristics and prices. However, ELIWELL IBÉRICA, S.A. reserves the right to withdraw, replace or change the products offered through its website, by simply changing the content of the website. In this way, the products offered at any given time on the website will be governed by the General Contracting Conditions in force in each case. Likewise, the company shall have the right to stop offering, without prior notice and at any time, access to the aforementioned products.

The products offered in our online shop, incorporate a photograph and the essential characteristics of the same, this is the information obtained from the manufacturer itself. The colour of the product, observable in the photograph is not binding. It is identified in the characteristics.

ELIWELL IBÉRICA, S.A. makes the quality declaration available to the customer, as it complies with the quality standards set out in ISO 9001:2008. Therefore, the products delivered will conform to the specifications shown in the current catalogue.

9.1. All products offered on the website enjoy the commercial guarantee of the supplier thereof. ELIWELL IBÉRICA, S.A. has an after-sales service, while the warranty is in force, the customer may execute it by contacting the establishment of ELIWELL IBÉRICA, S.A., the after-sales service, by email to sat@eliwell.es . In case of doubt, the Customer may contact the customer service telephone number 963134204 or by e-mail to info@eliwellstore.es.

9.2. The guarantee may be executed up to 12 months following the shipment of the product or products purchased.

9.3. ELIWELL IBÉRICA S.A. guarantees that it will replace, repair or pay, at its option, the products supplied, in which, always in proper use, manufacturing defects appear, and always subject to the provisions of the returns section.

All products indicate the selling price in Euro and do not include Value Added Tax (VAT).

Please note that.

10.1. The costs of Canary Islands General Indirect Tax (IGIC) and Customs are not included in the total of the order, therefore, they will not appear on the invoice. These costs must be paid to the carrier at the time of delivery of the order.

10.2. Orders for delivery in the Canary Islands, Ceuta and Melilla do not include VAT. In the event that the amount is reflected in your order confirmation, it will not be included in the invoice.

10.3. Customs information. When the order is to be delivered to a country outside the European Union, and there is an obligation to pay import duties and taxes, they will be charged to the buyer at the time the package arrives at its destination. Any additional amount due to customs clearance shall be borne by the buyer. ELIWELL IBÉRICA,S.A. has no control over such amounts as customs policies vary significantly from country to country.

ELIWELL IBÉRICA, S.A. delivers to the Iberian Peninsula, Balearic Islands, Canary Islands, Ceuta and Melilla, the cost of delivery and shipping costs will be established in each purchase agreement.

11.2. Deliveries will be made to the delivery address indicated in the order by the transport proposed by ELIWELL IBÉRICA, S.A., unless otherwise indicated by the Customer. In which case, the shipping costs shall be borne by the customer. The proposed transport is an express transport, with delivery within 24/48h from the confirmation of the order by ELIWELL IBÉRICA, S.A.

11.3. In the event that there are costs associated with shipping, they will appear in the purchase agreement. This agreement must be confirmed by the Customer for acceptance.

11.4. ELIWELL IBÉRICA, S.A. is exempt from any liability for damage to products or delayed deliveries in the event that the Buyer has chosen another means of transport or another carrier other than the one proposed by ELIWELL IBÉRICA, S.A.. In such cases, the costs incurred by the shipment of the goods shall be as agreed between the customer and the carrier chosen by him, and the responsibility for the product by ELIWELL IBÉRICA, S.A., will end when the material is delivered to the carrier. If the transport is chosen by the Customer, it will be necessary to indicate the order number to make the collection at the ELIWELL IBÉRICA, S.A. warehouse.

11.5. Shipments to the Canary Islands, Ceuta and Melilla.

11.5.1. The delivery time for the Canary Islands, Ceuta and Melilla is approximately one week. The delivery times shown on the website are for orders delivered to the Peninsula.

11.5.2. Orders for delivery in the Canary Islands, Ceuta and Melilla do not include VAT. In the case of the Canary Islands, the applicable tax is the Impuesto General Indirecto Canario (IGIC) and in the case of Ceuta and Melilla, the Impuesto sobre la Producción, los Servicios y la Importación (IPSI).

11.5.3. In any case, if during your order VAT appears on your order confirmation, it will not be included in the invoice.

11.5.4. The costs of IGIC (local tax) and Customs, and the IPS are not included in the order total, therefore, will not be reflected in the invoice. These costs must be paid to the carrier at the time of delivery of the order.

The recipient of an international shipment may be subject to import duties and taxes, which are levied once the shipment arrives in your country. As a general rule, additional charges for customs clearance must be borne by the consignee ( DAP ).

The customer will be able to pay the amount of his order by any of the following ways

The availability of products offered by ELIWELL IBÉRICA, S.A. may vary depending on customer demand. Although ELIWELL IBÉRICA, S.A. updates the stock periodically, the product requested by the customer may be out of stock at that time. In the event of non-execution due to unavailability, ELIWELL IBÉRICA, S.A. will notify the customer by e-mail as soon as it becomes aware of this situation. The period of this communication shall in no case exceed a maximum period of 30 days. ELIWELL IBÉRICA, S.A. shall have the dual option of: supplying the Customer with no price increase, a product with similar characteristics or of superior quality, or, unless ELIWELL IBÉRICA, S.A. has justified and demonstrable reasons, paying the sums paid for the cancelled order within the same period. In the event that ELIWELL IBÉRICA, S.A. does not make this payment within the aforementioned period, the Buyer may claim to be paid double the amount due, without prejudice to its right to compensation.

15.1. Withdrawal

The purchaser shall have a maximum period of fourteen calendar days to withdraw from the contract, starting from the day the customer receives the product, without any penalty and without stating the reasons.

The exercise of the right of withdrawal must be made by means of notification via e-mail to sat@eliwell.es, sending your letter with information on the order number and invoice number corresponding to the order you wish to exercise the right of withdrawal. The customer will receive an incident number by e-mail from where the notification of the right of withdrawal is made.

In accordance with the provisions of article 103 of Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users, the supply of goods made according to the specifications of the consumer and user or clearly personalised, as well as those that may deteriorate or expire rapidly, shall be subject to the following conditions

15.2. The return

The return of the material shall be conditional on the products or parts to which the return refers being returned in accordance with the notification and with the incident number sent by sat@eliwell.es. In addition, the following aspects shall be taken into account:

15.2.1. Return due to the exercise of the Guarantee.

This must comply with the provisions of section 10 of these general conditions of contract and must always be made within the period of 12 months.

15.2.2. In the case of return due to withdrawal or error attributable to the customer:

It must be previously authorised by the incident department, which will have managed the request by means of the incident number. If the return proceeds and has been authorised by the incident department, the customer must return or deliver the product directly to ELIWELL IBÉRICA, S.A., at the address C Auguste and Louis Lumière, 26, PARQUE TECNOLOGICO DE PATERNA, 46980 PATERNA, VALENCIA, without undue delay, and in any case within a maximum period of 14 calendar days from the date on which the right of withdrawal from the contract is formalised. The deadline will be deemed to have been met if the customer returns the product before the end of the period. The product must arrive complete with no signs of use.

The customer shall bear the costs of returning the product.

15.2.3. In the case of return due to defect and the causes attributable to this, are not a consequence of the customer:

The Customer shall be entitled to return the product, informing ELIWELL IBÉRICA, S.A. of the reason for return by any of the means provided in these Terms and Conditions of Contract.

This return due to a defect or poor condition of the product shall not be considered a right of withdrawal.

ELIWELL IBÉRICA, S.A. will check the returned defective product. In case of defect and are not attributable to the customer, the product will be replaced by another of the same characteristics, or once repaired will be returned in perfect condition to the customer.

15.2.4. Return requirements

In any case, the products to be returned must be in perfect condition, unused and in their original packaging, with their documentation and the accessories originally included with the product.

We therefore ask that, in order to avoid problems during transport, you ensure that the package is properly protected and sealed. Once received, we will check its condition. As soon as we check that the item/s, as well as any components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will proceed to refund the money paid.

After expiry of the return period, whatever the reason for the return, ELIWELL IBÉRICA, S.A. reserves the right to accept the return and, if it does so, to charge a handling fee, if any.

15.3. Refund of payment

The refund of the amounts received by the Customer shall be made using the same means of payment used by the Customer, unless otherwise provided. ELIWELL IBÉRICA, S.A. may withhold reimbursement until it has received the product, which is the reason for withdrawal, or until the Customer provides proof of return of the product, whichever condition is met first.

In the event of unjustified delay on the part of ELIWELL IBÉRICA, S.A., with respect to the refund of the sums paid, the Customer may claim double the sums paid, without prejudice to the right to be compensated for damages suffered in excess of that amount.

15.4. Complaints.

If the Customer wishes to make a complaint, the ELIWELL IBÉRICA, S.A. establishment is located at Auguste and Louis Lumière, 26, PARQUE TECNOLOGICO DE PATERNA, 46980 PATERNA, VALENCIA or via email info@eliwellstore.es.

These conditions of sale shall be governed by and construed in accordance with the laws of Spain (with the exception of its conflict of law provisions), expressly excluding the application of the United Nations Convention on Contracts for the International Sale of Goods. Both parties agree to submit to the non-exclusive jurisdiction of the courts of the city of Valencia.
